ORDER OF PERMANENT INJUNCTION
On February 4, 1997, this matter came on for trial. On August 27, 1997, this Court entered its findings of fact and conclusions of law, which found that Plaintiff is not entitled to any relief on its claims and that Defendants and Counterclaimant are entitled to judgment and a permanent injunction under California Business & Professions Code §14415 and 14402. Good cause appearing therefor, IT IS HEREBY ADJUDGED, DECLARED AND ORDERED that:
1. Absent express written authorization from SOS West Secular Organizations for Sobriety, Inc., Plaintiff Secular Organizations for Sobriety, Inc., its predecessors, successors, parent organization or other affiliates (including without limitation the Council for Secular Humanism (formerly CODESH)), directors, officers, agents, servants, employees, representatives and all persons or groups acting on their behalf under their direction or authority, and all persons acting in concert or in participation with them who have received actual notice of this Permanent Injunction, are permanently enjoined as of October 10, 1997 from
a) holding meetings or offering services under the names or marks Secular Organizations for Sobriety or SOS (used alone or in combination with other words), or any confusingly similar variations thereof, in any county in the State of California north of the line formed by the northern borders of San Luis Obispo, Kern, and San Bernardino Counties (hereinafter "Northern California");
b) promoting or advertising in Northern California in any manner, including without limitation by electronic means such as a computer network, an electronic bulletin board, the internet, and/or a "website", any goods or services using the names or marks Secular Organizations for Sobriety or SOS (used alone or in combination with other words), or any confusingly similar variations thereof, without prominent mention or display in conjunction with such promotional or advertising statements of the following notice:
"SOS IS INCORPORATED IN CALIFORNIA AS SOS WEST SECULAR ORGANIZATIONS FOR SOBRIETY, INC., A MEMBER-OWNED, NONPROFIT CORPORATION. SOS WEST IS NOT AFFILIATED WITH THE COUNCIL FOR SECULAR HUMANISM (FORMERLY CODESH) "
c) soliciting for members or funds in Northern California in any manner including without limitation by use of a "website," by use of the names or marks "Secular Organizations for Sobriety" or "SOS" (used alone or in combination with other words), or any confusingly similar variations thereof, without including with such solicitations the notice stated in paragraph (b) hereto;
d) making or causing to be made any written or oral statements that SOS West Secular Organizations for Sobriety, Inc., its member groups, or any Defendant in this action, advocates, or has ever advocated, controlled drinking.
2. Plaintiff Secular Organizations for Sobriety, Inc., its predecessors, successors, affiliates, directors, officers, agents, servants, employees, representatives and all persons or groups acting on their behalf under their direction or authority, and all persons acting in concert or in participation with them who have received actual notice of this Permanent Injunction, are ordered to deliver to the Court within thirty (30) days of entry of this Permanent Injunction a list of all sobriety groups in Northern California of which they are aware, other than groups affiliated with Defendant and Counterclaimant SOS West Secular Organizations for Sobriety, Inc., that are using in any manner the names or marks "Secular Organizations for Sobriety" or "SOS" (used alone or in combination with other words), or any confusingly similar variations thereof.
3. This Court shall retain jurisdiction over this action and the Parties to the extent necessary to enforce this Permanent Injunction.
